POLIMAIR": refers to the company POLIMAIR, a société par actions simplifiée (simplified joint stock company) with a share capital of 21,000 euros, registered in the Paris Trade and Companies Register under number 919 649 731, having its registered office at 24 rue Muller - 75 018 Paris, France, which publishes the Internet Site and offers and sells Products to Customers.

Customer" : refers to the natural person or legal entity having created an account on the Internet site and ordering a Product as a consumer. "
General Conditions": designates the present general sales conditions defining the terms and conditions of sale of Products to the Customer by the company POLIMAIR.
- "
Products": designates the products offered for sale and sold by the company POLIMAIR on the Internet site, as defined in article 2 of the general conditions.

Internet Site": refers to the Internet site of the company POLIMAIR available at the address https://www.polimair.fr/. These general terms and conditions of sale are concluded, on the one hand, by SAS POLIMAIR, which manages the www.polimair.fret website, and, on the other hand, by any individual or legal entity wishing to make a purchase via the
https://www.polimair.fr/ website, hereinafter referred to as "the Customer".
Preamble
Article 1 | Purpose and general provisions
The purpose of these terms and conditions of sale is to define the contractual relationship between POLIMAIR and the customer, and the conditions applicable to all purchases made via the https://www.polimair.fr/ website.
The general terms and conditions of sale can be viewed on the https://www.polimair.fr/ website. At the time of purchase, the Customer declares that he/she has read the general terms and conditions of sale and accepts them without restriction or reservation by ticking a box with a validation click.
The Customer declares that he/she has full legal capacity, enabling him/her to commit to these general terms and conditions of sale.
POLIMAIR reserves the right to modify these general terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Consequently, the applicable conditions will be those in force at the date of the order by the Customer.
Article 2 | Products
The products offered are those shown on the https://www.polimair.fr/ website, while stocks last. POLIMAIR reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible, but are not binding on the seller. The sale of products presented on the https://www.polimair.fr/ website is intended for all Customers residing in countries that fully authorize the entry of these products into their territory.
Article 3 | Product customization
POLIMAIR offers customers the possibility of customizing the colors of the products they wish to order on the Site.
Article 4 | Rates
The prices appearing on the product sheets of the internet catalog are in Euros (€), all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. POLIMAIR reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order shall be the only price applicable to the Customer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order.
Delivery charges are indicated at the time of ordering in euros (€), inclusive of all taxes. They vary according to the content of the order.
Article 5 | Terms of payment
All orders are payable in full by the Customer.
The following methods of payment are available to the Customer:
- Bank card: Visa and Master Car
- ApplePay
- Paypal
The Customer must enter his bank details.
The Customer's provision of his bank card number constitutes authorization to debit his account for the full amount of the order.
All orders involving payment by credit card are considered effective only when the relevant payment centers have given their approval.
All data transmission by the Customer is carried out in a secure environment using current Internet protocols.
Online payments are made via the STRIPE secure system.
Article 6 | Online contract conclusion
The Customer must follow a series of steps specific to each product offered by the seller in order to complete the order. However, the steps described below are systematic:
- Choice of Product, if applicable its options, and indication of the Customer's essential data (identification, address...)
- Acceptance of these General Terms and Conditions of Sale.
- Verification of order elements and, if applicable, correction of errors.
- Follow-up of payment instructions, and payment for products.
- Delivery of products. The Customer will then receive confirmation by e-mail of payment for the order, as well as an acknowledgement of receipt of the order confirming it. For products delivered, this delivery will be made to the address indicated by the Customer. In order for the order to be processed correctly, and in accordance with article 1316-1 of the French Civil Code, the Customer undertakes to provide correct identification details. The seller reserves the right to refuse the order, for example in the case of any abnormal request, made in bad faith or for any legitimate reason.
Article 7 | Retention of title
POLIMAIR retains full ownership of the products sold until full payment has been received, including all costs and taxes.
Article 8 | Delivery
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Delivery times are given as an indication only.
POLIMAIR may provide the customer with the tracking number of his parcel by e-mail. The customer is delivered to his home by the delivery person chosen by the company POLIMAIR. The Customer must be at home at the time of delivery. The risks associated with transport are borne by the purchaser from the time the items leave the premises of the company POLIMAIR.
The customer is obliged to check the condition of the packaging and the contents of the goods on delivery in the presence of the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 9 | Warranty
All products supplied by POLIMAIR are covered by the legal warranty stipulated in Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to the company POLIMAIR which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made electronically to the following address: contact@polimair.fr, within thirty days of delivery.
Article 10 | Withdrawal
In accordance with article L121-20 of the French Consumer Code, the Customer has a period of fourteen (14) days from the date of delivery of his/her order to exercise his/her right of withdrawal and return the product to the seller for exchange or reimbursement without penalty. However, the cost of returning the product will be entirely at the customer's expense.
Article 11 | Product return procedure
Regarding the procedure for returning products, the Customer must assert his right of withdrawal:
- either by duly completing the withdrawal form proposed in annex
- or by duly completing the withdrawal form available in your account (tab "my orders")
- or by mail, enclosing a copy of his invoice corresponding to the purchase as well as any document attesting to the date of receipt of the products (ex: delivery note...) for identification by the POLIMAIR company of its order, to the following address:

POLIMAIR's after-sales service will contact the customer within 72 hours to explain the return procedure.
The customer must place all the products in the package(s) and carefully prepare the return package(s).
The customer must return the products in their original packaging and in perfect condition.
Returns will only be accepted if the product return procedure has been respected by the Customer.
The Customer will not be able to exercise his right of withdrawal if the returned products are unfit for resale, for example due to obvious deterioration.
Where delivery has been made by carrier, the Customer may either return the products by his own means, or, where he is unable to do so, the company POLIMAIR shall make available to the Customer and at the latter's expense a take-back service, the cost of which shall amount to the cost of the initial delivery excluding any discount.
In the event of products being returned by the Customer who has exercised his right of withdrawal in accordance with the present article, the Customer shall assume the risks of transport.
Article 12 | Exchange, refund of products
Customers who have exercised their right of withdrawal have the option of requesting an exchange of the products or a refund.

If the Customer wishes to exchange the products, returns will only be accepted by POLIMAIR if the returns procedure described in Article 11 above is duly complied with.
Once the return has been accepted by POLIMAIR, the Customer's request will be processed by POLIMAIR. The new products will be delivered within a reasonable period of time. The new products will be delivered to the Customer within a reasonable period of time.
If the products ordered by the Customer are not available, the company POLIMAIR will inform the Customer and proceed with the reimbursement of the order under the conditions described below.

When the right of withdrawal is exercised, the company POLIMAIR undertakes to reimburse the customer within fourteen (14) days following the date on which this right was exercised, after having carried out all checks on the products.
The method of reimbursement will be carried out according to the means of payment chosen by the customer minus the costs of taking back the products when the option of returning the products has been chosen by the customer.
Any product damaged by the Customer will not be reimbursed.
Article 13 | Assembly
In the event of improper installation or damage to the products during assembly by the customer and/or a person of his/her choice, POLIMAIR shall not be liable for any resulting damage, in accordance with legal provisions, and declines all liability in such cases.
Article 14 | Liability
POLIMAIR is only bound by an obligation of means in the distance selling process. POLIMAIR cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruptions or other involuntary problems.
Article 15 | Intellectual property
The content of this site (texts, logos, graphic and/or sound images....) is the property of POLIMAIR and is protected by French and international intellectual property laws. The content may not be copied, reproduced or recorded in any way whatsoever.
Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
POLIMAIR is the owner of intellectual property rights in respect of copyright, designs and models, or other rights of a similar nature.
In addition, the Customer may only access and display the content of the database and any other element of the Site for non-commercial and private use.
Article 16 | Personal data
POLIMAIR undertakes to maintain the confidentiality of any information provided by the customer which may be required for the use of certain services.
All information concerning the customer is subject to the provisions of law no. 78-17 of January 6, 1978. As such, Internet users have the right to access, modify and delete information concerning them. They may request this at any time by e-mail to the following address: contact@polimair.fr.
Article 17 | Dispute settlement and liability
The customer is responsible for verifying the completeness and truthfulness of the information provided to POLIMAIR when ordering, in particular the delivery address.
The customer is responsible for the information provided when registering and ordering. POLIMAIR cannot be held responsible for any input errors that may lead to delivery errors. If the delivery address proves to be incorrect or if the Customer decides to change the delivery address after the products have been dispatched by POLIMAIR, the costs of the new delivery shall be borne by the Customer.
The Customer's choice and purchase of the products are his sole and exclusive responsibility. Consequently, the total or partial impossibility of using the products, in particular due to incompatibility of the product, shall not give rise to any compensation, reimbursement or liability on the part of POLIMAIR, except in the case of a proven latent defect, non-conformity, defect or exercise of the right of withdrawal provided for in the provisions of the French Consumer Code.
POLIMAIR shall not be held liable for any damage resulting from misuse of the products by the customer or in the event of an act of God or force majeure.
Any act or circumstance that is irresistible, unforeseeable and beyond the control of the parties, in particular in the event of a nationwide strike by transporters, or natural disasters such as floods or fires, shall be deemed to constitute an act of God or force majeure and shall exempt POLIMAIR from liability.
These conditions of distance selling are governed by French law. For all disputes or litigation, the competent court will be the court of PARIS.
